Welcome to OpenEar. These Terms & Conditions ("Terms") outline the rules for using our mobile application and services. By installing or using OpenEar, you agree to these Terms. Please read them carefully before proceeding.

OpenEar is owned and operated by Ripple Services, based at: 22/10, 12th Floor, Mani Casadona, Newtown AA2F, Kolkata, West Bengal, India – 700161.

1. What OpenEar Offers

OpenEar provides a digital space where individuals can connect with trusted Listeners for supportive conversations.

  • Our goal is to offer empathy, understanding, and safe expression.
  • We are not a medical or psychiatric service and do not provide diagnosis or treatment.
  • In case of emergencies, please contact local authorities, hospitals, or helplines immediately.

2. Who Can Use OpenEar

  • You must be 18 years or older to create an account.
  • If you are under 18, you may only use the app with supervision of a parent or legal guardian.
  • By registering, you confirm that the information you provide is true and accurate.

3. Your Responsibilities

When using OpenEar, you agree not to:

  • Harass, abuse, or insult Listeners or other Users.
  • Share harmful, offensive, or unlawful content.
  • Record or distribute conversations without consent.
  • Misuse the platform for commercial, fraudulent, or exploitative purposes.
  • Attempt to interfere with or damage the app's functionality.

You are responsible for your behavior and the information you share.

4. Subscriptions & Payments

  • Some features may require a paid subscription.
  • Prices and payment details will be clearly displayed in-app.
  • Fees are generally non-refundable except where required by law.
  • Wallet top-ups or in-app credits, once purchased, cannot be transferred back to bank accounts.
  • OpenEar may revise pricing or features with prior notice.

5. Privacy & Confidentiality

  • Conversations are designed to remain private and anonymous.
  • We do not sell or trade your personal data.
  • However, if we believe there is a serious risk of harm to you or others, or if required by law, we may share necessary information with relevant authorities.
  • Our Privacy Policy is an extension of these Terms and should be read together.

6. Our Limitations

  • Listeners are supportive peers, not licensed medical professionals.
  • OpenEar cannot guarantee that conversations will solve problems or replace therapy.
  • We do not take responsibility for decisions you make based on interactions in the app.
  • To the maximum extent permitted by law, OpenEar is not liable for damages, losses, or claims arising from use of the app.

7. Intellectual Property

  • The OpenEar name, logo, design, and app content are owned by Ripple Services.
  • Users may not copy, modify, or reuse any part of the app without written permission.

8. Suspension & Termination

We may suspend or terminate accounts that:

  • Violate these Terms,
  • Misuse the app, or
  • Harm the safety of our community.

Termination does not remove obligations related to confidentiality, limitations of liability, or indemnity.

9. Indemnity

You agree to protect and hold harmless OpenEar, its team, and Listeners from any claims, costs, or damages resulting from your misuse of the app or violation of these Terms.

10. Governing Law

  • These Terms are governed by the laws of India.
  • Any disputes will fall under the jurisdiction of the courts in Kolkata, West Bengal, India.
  • Disputes may also be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996, conducted in English.

11. Updates to Terms

We may update these Terms to reflect changes in our services or legal obligations. Updates will be posted in the app. Continued use means you accept the revised Terms.
